OMB recommends that the FCC require incumbent LECs to provide this information to potential competitors as well as competitors upon request. The FCC may also wish to examine ways to ensure that information requests are not done to unduly burden incumbents, perhaps allowing carriers to charge reasonable fees for subsequent requests or for more customized data requests. The FCC shall work with the Small Business Administration and other entities representing small telecommunications companies and cooperatives to ensure that the rules implementing these requirements are developed with adequate input and properly reflect their concerns regarding burden and costs. OMB expects the FCC to submit this item as a revision after the NPRM phase is completed and comments are incorporated regarding cost and hour burdens. OMB understands that many of the items in this collection may or may not be adopted by individual States. OMB also believes that the FCC should monitor actual levels of use of this information to verify that, in fact, CLECs are making use of this information to provide services and competition. This information could be obtained by doing annual surveys of ILECs to determine the number of requests and resources devoted to meeting these requests -- and take appropriate action to drop requirements not being taken advantage of. If the FCC decides to collect information on to do this analysis, or to expand upon analysis conducted to determine whether statistically significant differences exist between a ILEC and its competitors, the FCC shall obtain specific OMB approval. OMB is particularly conerned about the ability of small and rural LECs to provide this information and recommend that the FCC examine use of a smaller set of OSS requirements for carriers meeting certain criteria. The FCC must also address the potential lack of existing electronic OSS capabilities at smaller firms to ensure that undue cost burdens are not imposed on these carriers in order to meet proposed information sharing requirements. Comments of OPATSCO and NCTA address these issues and raise important questions regarding the utility (under the PRA) of these requirements that could be imposed on small carriers not facing demands for interconnection.
