Terms of Clearance: This ICR is not approved. When EPA resubmits this ICR in conjunction with the final Class V rule, it should ensure that the requirements in 5 CFR 1320.9(a)(3) to reduce to the extent practicable and appropriate the burden on persons who shall provide information to or for the Agency and in 5 CFR 1320.8(a)(4) to provide a specific, objectively supported estimate of burden are satisfied. In particular, the Agency should carefully reconsider the proposed provision that if a state fails to complete its source water assessment program by May 2003, the rule would apply to all Class V motor vehicle and industrial wells and large capacity cesspools in the state, rather than only to those in source water protection areas. This could unnecessarily impose significant burden on many well operators who are not endangering underground sources of drinking water. The agency should also reevaluate its proposal to require operators of Class V motor vehicle wells in source water protection areas who are able to meet all MCLs at the point of injection to nonetheless obtain a permit and monitor at specified frequencies, when no such requirement is being proposed for operators of Class V industrial wells who are able to meet all MCLs at the point of injection. The Agency should also reevaluate its projection that all states will complete their source water assessment programs by the May 2003 deadline. As the Economic Analysis for the proposed rule notes, "If even a few states fail to meet the deadline, and as a result the rule is implemented statewide, the costs (and corresponding burden) would increase significantly."

Abstract: This proposal would ban large-capacity cesspools and motor vehicle waste disposal wells in ground water-based source water protection areas. Owners and operators in direct implementation States would be required to submit a preclosure notification 30 days prior to closure. Owners and operators of motor vehicle waste disposal wells could receive a waiver and apply for a permit to continue using their well if they can demonstrate that they meet primary drinking water standards at the point of injection.
