Abstract: Section 655.103(f) of the proposed rule provides that agricultural employers of nonimmigrant workers do not have to use Farm Labor Contractors (FLC) that are on the Employment Standards Administration's list of debarred contractors or INS' list of employers that have been sanctioned for violating immigration laws and regulations. The proposed rule also provides a procedure so that an employer can receive an exception from using FLCs that are not on ESA's list of debarred contractors or on the list of employers that have been sanctioned for violations.
