Terms of Clearance: OMB approves this collection with the understanding that the entire SHVA issue is the subject of intense Congressional and industry action, as well as an ongoing FCC rulemaking. Although the information collections proposed in this item are broad and general, OMB believes that once the final rulemaking regarding how the so-called B contour is measured will not be considered a collection of information under the Paperwork Reduction Act. In the interim, this collection is approved -- but OMB expects the FCC to revise it after finalizing the rulemaking and interpreting the effects of any Congressional action. If the final rule only establishes mechanisms for determining the contour which do not meet the PRA definition of a collection of information, and the FCC imposes no additional collection, third party notifications, or records retention requirements on parties than this collection should be eliminated.

Abstract: The Commission has released a notice of proposed rulemaking (NPRM) in the matter of satellite delivery of network signals to unserved households for purposes of the Satellite Home Viewer Act and definition and measurement of signals of Grade B intensity ("SHVA NPRM"). In the SHVA NPRM, the Commission addresses its methods for determining whether a consumer is receiving an adquate television network signal under the 1988 Satellite Home Viewer Act.
