OMB strongly
encourages the FCC to adopt procedures in this rulemaking that
would reduce the burden imposed on small entities and that also
could better utilize information collected via other mechanisms
(such as other EEOC collections where possible). The FCC is also
encouraged to explore use of surveys and other statistical sampling
mechanisms to monitor industry trends in lieu of required periodic
filings. The FCC shall resubmit this collection for OMB review
after the rulemaking is completed and shall file correction
worksheets for any changes that affect other/existing
collections.

On 11/19/98, the Commission adopted an
NPRM in MM Docket 98-204. This rulemaking proceeding is initiated
to obtain comments concerning the Commission's proposed EEO rules
and policies that would be consistent with the D.C. Circuit's
decisions in Lutheran Church. This rulemaking proposes to initiate
a new broadcasting EEO rule and to change the cable EEO rules, to
emphasize recruitment outreach programs and provide that entities
are not to use racial, ethnic, or gender preference in
hiring.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
