Terms of Clearance: In accordance with the provisions of 5 CFR 1320.11, OMB is not approving the proposed collection at this juncture. OMB is interested in any comments that members of the public may have with respect to the practical utility and burden of this collection. OMB is also concerned that the eight-year record retention requirement may lack practical utility. Accordingly, EPA should resubmit the collection, revised to reflect consideration of comments, to OMB for review at the time of the final rule. At that time, EPA should also be careful to include an accounting of any testing costs associated with the proposed collection, and to include any burden borne by respondents' contractors. EPA shall include in its submission any comments received on the proposed rule or on this ICR that pertain to the proposed collection, and ensure that those comments and the comments herein are addressed in EPA's written submission.
