This revision to the ICR to reflect new record keeping and reporting requirements in the proposed rule to lower reporting thresholds for certain PBT chemicals is not approved. The agency has not demonstated that all of the information collected will have practical utility as required by 5 CFR 1320.9. Of specific concern are the removal of the de minimis exemption, range reporting, the half-pound rule, and the alternative threshold option for PBT chemicals. In addition, the agency has not demonstrated that the proposed thresholds are necessary to adequately inform the public of health risks within local communities or that they reduce to the extent practicable and appropriate the burden on persons who shall provide information as required by 5 CFR 1320.9(c). These concerns should be addressed when the agency resubmits this ICR revision with the final rule.

This is a proposed addendum to the existing ICR approval to collect information under the Emergency Planning and Community Right-to-Know Act (EPCRA) section 313 and section 6607 of the Pollution Prevention Act of 1990. Reporters submit information concerning toxic chemical releases into the air, land, and water. This addendum is related to the proposed TRI-PBT rulemaking, which proposes to lower the reporting threshold for PBTs.
