Terms of Clearance: In accordance with 5 CFR 1320, OMB is withholding approval for the submitted revision until publication of the final rule. Before publication of the final rule, the Agency should address the questions and concerns mentioned below, and report its findings, along with any comments regarding these or other related issues, back to OMB. (1) The Agency must submit a copy of the compliance agreement form to OMB. (2) The Agency must account for the capital costs associated with changing the sticker. (3) The Agency must demonstrate the practical utility of changing the sticker, given that the incentive for duplication of the sticker, which is sited as the reason for changing the design, remains and that the Agency is not taking action to deter duplication of the new design. Additionally, in the next submission, the Agency must report to OMB any information based on experience or public comments that addresses (1) the burden associated specifically with the compliance agreements and (2) whether or not the agreements will effectively deter importers and distributors from shipping to unapproved states or through non-participating distributors.

Abstract: Hass Avocado fruit from Mexico is to be imported into certain areas of the United States, under certain conditions. We are proposing several changes to the regulations to amend the stickering requirement and to add requirements regarding the repackaging of the avocados after their entry into the United States. We are also requiring handlers and distributors to enter into compliance agreements with APHIS. These proposed amendments will reinforce the existing safeguards of the avocado import program.
