Abstract: The Food and Drug Administration (FDA) has published regulations to implement provisions of the Safe Medical Devices Act (SMDA) of 1990 (Pub. L. 101-629) amending the Food, Drug, and Cosmetic Act (the Act). Section 513 of the Act, as amended by the SMDA on November 28, 1990, specifically section 513(i)(3), requires that a premarket notification filed under section 510(k) shall include an adequate summary of any information respecting safety and effectiveness (510(k) summary) or a statement (510(k) statement) that such information will be made available upon request by any person.
