These proposed
revisions to the currently approved ICR governing the reporting and
record keeping requirements associated with the National
Pretreatment Program are not approved. OMB is concerned that some
of the revised requirements in the proposed rule may not have
practical utility, as required by 5 CFR 1320.9(a) and may not
reduce to the extent practicable and appropriate the burden on
persons who shall provide information to and for the agency, as
required by 5 CFR 1320.9(c). Specifically, OMB is concerned that
the proposed threshold for non-significant categorical industrial
users of 100 gpd may be too low, thus requiring many facilities
that would not otherwise be considered significant except by virtue
of their coverage under an effluent guideline to continue complying
with record keeping and reporting requirements of questionable
utility. Further, it is not clear that the requirement to publicly
list in a local newspaper as being in significant non-compliance
industrial users who have complied with all applicable requirements
except that one or more reports were filed more than 30 days past
the reporting deadline serves any useful purpose. EPA should
address these concerns in its consideration of possible changes for
the final rule.

The ICR provides an analysis of the
burden and costs associated with managing the National Pretreatment
Program mandated by section 402(a) and (b) and 307(b) of the Clean
Water Act. This ICR includes revisions to the current ICR for the
National Pretreatment Program, OMB Control No. 2040-0009, EPC ICR
No. 0002.08, that would result if certain provisions of a proposed
rulemaking for Streamlining the General Pretreatment Regulations
for Existing and New Sources of Pollution are adopted.
