Section 402 of the Clean Water Act establishes the NPDES program to regulate the discharge of any pollutant from point sources into waters of the United States. CWA section 402(p) authorizes the Administrator to issue permits for storm water discharges. Stormwater regulations are found in 40 CFR part 122. EPA needs the information collected in the Construction Notice of Intent (NOI) to provide coverage to applicants for stormwater discharges associated with construction activity disturbing greater than 5 acres under the NPDES Construction Stormwater General Permit.
