Terms of Clearance: This ICR is not approved. It is not clear that the requirement for construction sites (which will be considered new dischargers as defined in the proposed rule) to obtain coverage under individual permits rather than general permits when discharging to impaired waters has practical utility, as required by 5 CFR 1320.9(a) and reduces to the extent practicable and appropriate the burden on persons who shall provide information to or for the agency, as required by 5 CFR 1320.9(c). In particular, since these sites will already be required to have stormwater pollution prevention plans to minimize the discharge of sediment and other pollutants of concern, and since it may be difficult to obtain offsets for sediment discharges, it is not clear how this provision would operate in practice to improve water quality. EPA should reevaluate this provision as it develops the final rule.

Abstract: Proposed revisions to the NPDES Program and Water Quality Standards in support of revisions to the Total Maximum Daily Load (TMDL) Program, including two sets of provisions which are addressed by this ICR. The offset provision requires that new or significantly expanding dischargers that are large entities and located on impaired waterbodies must achieve a 1.5:1 offset of pollutant load until a TMDL is done for the waterbody or the discharge ceases.
