Terms of Clearance: This ICR is approved. The burden calculations in this ICR correspond to the first three years of the revised Class V UIC program during which new requirements for motor vehicle waste disposal wells and large capacity cesspools will be being phased in. Specifically, the ICR includes burden and costs for closing 1089 cesspools, or two fifths of the estimated 2723 cesspools that will be affected by the rule. It also includes burden and costs for 374 motor vehicle wells, of which 103 are projected to close and 271 are projected to obtain a permit. This represents one half of the 745 motor vehicle wells in ground water protection areas that are projected to be affected. In addition, an estimated 4579 motor vehicle wells in other state designated sensitive areas are projected to be affected during the 2004-2007 time frame. When this ICR is renewed, the agency should carefully consider what burden adjustments are needed to reflect the burden of the program over the following three years, taking into account the timing of the requirements and any new information that may become available on the number of affected wells (for example if the program is likely to become effective statewide because states do not complete source water assessments or delineation of sensitive groundwater areas by the specified deadlines).

Abstract: The final rule bans new motor vehicle waste disposal wells and new and existing large capacity cesspools nationwide and bans existing motor vehicle waste disposal wells in groundwater protection areas and other sensitive groundwater areas with a waiver provision allowing well owners/operators to seek a permit to continue using their well if they can demonstrate that injected fluids meet primary drinking water standards at the point of injection. All owner/operators are required to submit a preclosure notification 30 days prior to well closure.
