1999 EPCRA Implementation Status Questionnaire for State Emergency Response Commissions (SERCs), Local Emergency Planning Committees (LEPs), and CA Certified Unified Program Agencies
New collection (Request for a new OMB Control Number)
This ICR is approved under 5 CFR 1320. The Supporting Statement states that the primary goals of the survey are to "[p]robe current SERC, LEPC, and CUPA practices and preferences regarding several important sets of issues...; [e]nable Region IX to facilitate the transfer of information on successful local program implementation to other local agencies; and [o]btain information essential to Region IX's decisions regarding the expenditures of federal program resources, including federal staff, contractors, training, enforcement and grants." EPA must not use the information collected for direct enforcement actions against SERCs or other local agencies that respond to the survey, which is strictly voluntary in nature and does not espouse such an enforcement purpose. This ICR is for a one-time collection. Given that EPA intends to use the results at a January 2000 conference, OMB has authorized data collection through April 2000, to allow for the possibility of delays. Followup collections will require new ICR submissions.

In order to improve the support of the United States Envionmental Protection Agency, Region IX, to regional partners, including State Emergency Response Commissions (SERCs), Local Emergency Planning Committees (LEPCs), and California Certified United Program Agencies (CUPAs), a questionnaire has been designed to better understand the Region's actual implementation of the Emergency Planning and Community Right-to-Know Act (EPCRA). This questionnaire will help EPA Region IX to establish a baseline from which to allocate their resources and to improve support to the State and local programs.
On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
