The information collect under FERC-598 is used to implement the statutory provisions of section 32 of the Public Utility Holding Company Act of 1935 (PUHCA), as added and redesigned by section 711 of the Energy Policy Act of 1992. Section 32(a) of PUHCA defines and Exempt Wholesale Generator (EWG) as an individual determined by FERC to be engaged directly or indirectly through one or more affiliates and exclusively in the business of owning and/or operating all or part of eligible facilities and selling electronic energy at wholesale.
