Terms of Clearance: Under 5 CFR 1320, OMB is not approving this ICR pending review of the final rule. EPA should resubmit a revised ICR to OMB at the final rule stage to support a decision on whether the revisions constitute a substantive change requiring a new Federal Register notice. In the revised Supporting Statement for the ICR, EPA must provide the assumptions and data underlying its estimates of laboratory costs, labor costs (including loading rates), and burden hours.

Abstract: The U.S. Environmental Protection Agency (EPA) is proposing to amend the regulations for hazardous waste management under the Resource Conservation and Recovery Act (RCRA). EPA is proposing to list as hazardous three wastes generated during the production of chlorinated aliphatics. This action is taken under the authority of RCRA section 3001(b)(1), which authorizes EPA to list wastes as hazardous, and section 3001(e)(2), which directs EPA to make a decision whether to list as hazardous the various chlorinated aliphatics wastes.
