EPA should review the public comments on the proposed rule and provide OMB with an evaluation of the comments and a discussion of any changes made in response to comments as a part of its resubmission of the ICR at the final rule stage. In the revised supporting statement, EPA should provide details on the assumptions and data underlying its estimates of labor costs (including loading rates) and burden hours. EPA should ensure that it calculates labor rates consistent with current EPA and OMB guidance.

Abstract: This clearance package provides burden estimates associated with the information collection requirements for the proposed condit- ional exemption from the definition of RCRA hazardous waste for mixed wastes that are stored, treated, and disposed, and for which the conditions of the exemptions are met. The regulations implementing the conditional exemption are proposed to be pub- lished in 40 CFR part 266.
