The agency is
instructed to take the actions necessary to allow for the
submission and processing of applications in an electronic format,
including but not limited to the acceptance of faxed applications
and the ability to submit applications via the Internet. OMB
requests that the agency report in 6 months on a plan to take this
action. The agency should also endeavor to publish in full on the
Internet applications received in electronic format for the purpose
of public review and comment.

The Endangered Species Act (ESA)
prohibits the taking of endangered species. Section 10 of the ESA
allows for certain exceptions to this prohibition, such as taking
that would be incidential to an otherwise lawful activity. NOAA has
issued regulations to provide for application and reporting for
such exceptions. The information is used to evaluate the proposed
activity (permits) and on-going activities (reports) and is
necessary for NMFS to ensure the conservation of the species under
the ESA.
