The Commission requires that incumbent wide-area 800 MHz SMR licensees who were within their construction period at the time of the Fresno decision may choose to apply the existing site-by- site, frequency-by-frequency construction requirements or the EA construction requirements. Thos choosing the latter must certify proof of compliance. This information collection also establishes a new licensing framework for the 800 MHz SMR service.
