Requirements and Petitions to Modify the List of Regulated
Substances (Proposed Rule for Distribution of Off-site Consequence
analysis information) under Sec 112(r).
This collection
is not approved at this time. EPA should resubmit the ICR at the
time of publication of the final rule to address comments from the
public and incorporate any changes in the final rule. OMB suggests
that EPA resubmit the collection under a separate control number to
avoid confusion with the collection of risk management plans that
is already authorized under OMB control number 2050-0144. The
resubmission should address public comments on this ICR, including
the need and practical utility of recording the names of facilities
whose RMPs are inspected by members of the public at federal
reading rooms. In resubmitting the ICR, EPA should be careful to
explain the basis for its estimate of the burden hours associated
with the collection, particularly with respect to the burden borne
by states and counties, and to ensure that the number of responses
is calculated correctly. In addition, to the extent that federal
reading rooms would be open only during normal business hours, EPA
should use the mean hourly wage as an estimate of the value of the
public's time.

This information collection request
(ICR) supports the Notice of Proposed Rulemaking for the
distribution of offsite conse- quence analysis information, under
CAA section 112(r) as amended by the Chemical Safety Information,
Site Security, and Fuels Regulatory Relief Act (P.L. 106-40). CAA
section 112(r)(7) re- quired EPA to promulgate reasonable
regulations and appropriate guidance to provide for the prevention
and detection of acciden- tal releases and for responses to such
releases. The regulations include requirements for submittal of a
risk management plan (RMP) to EPA.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
