This collection
is approved for three years subject to the following terms and
conditions. OMB understands that EPA is preparing a rule that would
implement the provisions of section 2 of P.L. 106-40, the Chemical
Safety Information, Site Security and Fuels Regulatory Relief Act.
Pending promulgation of that rule, EPA shall not require the
submission of RMPs by facilities that are covered under 40 CFR part
68 solely because they hold a fuel that EPA intends to remove from
the list pursuant to section 2 of P.L. 106-40. EPA should amend
this collection when it promulgates the rule pursuant to section 2
of the Act. OMB recommends that in that rule, EPA remove the
deregistration requirement for facilities that are no longer
covered by 40 CFR part 68 as a result of that rulemaking.

Under Section 112r of the Clean Air
Act, as amended, sources must register, document risk management
programs, and submit risk management plans to EPA by June 21, 1999.
The plans shall include information on a source's hazard
assessment, prevention program, and emergency response program. The
regulations, codified in 40 CFR part 68, also include requirements
for a petitioner to submit sufficient information in support of a
petition to scientifically support the request to add or delete a
chemical from the list of regulated substances. The Agency will use
this information in making the decision to grant or deny a
petition.
