This ICR is
approved pursuant to 5 CFR 1320. When EPA resubmits the ICR for
renewal, the Agency must evaluate, after consulting with
respondents, the burden estimates for reporting and recordkeeping
requirements. When calculating labor costs, the Agency must ensure
that it uses fringe and overhead loading rates that are consistent
with current OMB and EPA guidelines.

This rule would modify the existing
Facility Response Plan regulation (40 CFR part 112) as it applies
to facilities that handle, store, or transport animal fats and
vegetable oils. Because worst case discharges from approximately 63
animal fat and vegetable oil facilities could reasonably be
expected to cause substantial harm to the enviroment, owners, and
operators of these facilities are required to prepare and implement
response plans.
On behalf of this Federal agency, I certify that

1320.8(b)(3).
