Abstract: RM00-6-000 (Order No. 616) reinstates regulations to establish procedures for FERC to make determinations under Natural Gas Policy Act Section 503. A determination by FERC enables produc- ers of natural gas to claim credits for high cost gas as provided for by Section 29 of the Internal Revenue Code. The 10th Circuit Court held in a recent decision that a formal section 503 deter- mination is required to obtain the Section 29 tax credit.
