Terms of Clearance: This ICR is not approved. At the time of the final rule, EPA should resubmit the collection to OMB for review, together with any public comments received addressing issues related to the information collection and EPA's response to those comments. In particular, OMB notes that EPA should address OMB's comments on the initial proposal (OMB reference number 2060-0386). Specifically, EPA should review the practical utility of the requirements of this rule, e.g., the requirements to develop a fugitive dust control plan and a manual for the operation of baghouses. EPA should also consider alternative approaches that may reduce the burden associated with the proposal. Finally, EPA should re-evaluate the burden estimates associated with the collection. OMB reminds EPA that ICRs associated with a regulatory proposal should be accompanied by the Federal Register notice at the time of submission.
