The Patent and Trademark Office (PTO)
administers the Trademark Act, 15 U.S.C. et seq., which provides
for the Federal registration of trademarks, service marks,
collective trademarks, collective membership marks, and
certification marks. An individual or business that owns a valid
trademark or service mark and that uses or intends to use this mark
in commerce regulable by the U.S. Congress may apply to federally
register this mark. The mark will remain on the register for 10
years; however, the registration will be canceled by the PTO unless
an affidavit attesting to the continued use (or excusable
non-use)..
