Terms of Clearance: This ICR is not approved. It is not clear that all of the record keeping and reporting requirements have practical utility, as required by 5 CFR 1320.9(a), and that they reduce to the extent practicable and appropriate the burden on persons providing information, including small entities, as required by 5 CFR 1320.9(c). Of particular concern in this respect are the requirements for groundwater monitoring and record keeping, and the requirements for permit coverage and development of a permit nutrient plan for entities below the current regulatory threshold of 1000 animal units. Many of the potentially covered entities at the low end of the proposed regulatory range (300 or 500 animal units under alternative co-proposed options) are small entities as defined under the Regulatory Flexibility Act. Potentially burdensome reporting and record keeping requirements of questionable practical utility are of particular concern with regard to small entities. As it develops options for the final rule, EPA should carefully consider the practical utility of all reporting and record keeping requirements, including those mentioned specifically in these terms of clearance, and reduce to the extent practicable and appropriate the burden on affected entities, including small entities.

Abstract: This ICR calculates the burden and cost associated with the regulation of CAFOs under the NPDES program and the Effluent Limitations Guidelines. Specifically, it calculates the CAFO burden associated with NPDES permit applicatoin activities including permit nutrient plan development, data collection, and recordkeeping activities as required by the proposed rule. It also calculates the burden and cost associated with administrative activities performed by the State agencies that are authorized to issue CAFO permits under their NPDES system.
