Terms of Clearance: This ICR, which is associated with the proposed Metal Products and Machinery Effluent Guidelines, is not approved at this time. EPA should resubmit the ICR for consideration with the final rule. OMB generally supports the regulatory flexibility options that the proposed reporting and record keeping requirements are designed to support. The new reporting would allow facilities to certify that some pollutants are not present in their discharge in lieu of monitoring; to certify that they are implementing an organic chemicals management plan in lieu of monitoring for organic pollutants; and various other certification and demonstration options in lieu of potentially more burdensome monitoring and regulatory requirements. However, OMB is concerned that not all of the required information may be necessary to support these regulatory flexibility options. Also, OMB is aware that the details of these options may well change in the final rule as a result of comments received and further analysis by the Agency. The Agency should thus submit this ICR for reconsideration with the final rule. The Agency should structure the reporting requirements to minimize burden on respondants while still receiving adequate information to support the regulatory flexibility options.

Abstract: The MP&M rulemaking is creating a new effluent limitations guide- lines and standards ("effluent guidelines") point source category (40 CFR 438). This new category will replace the existing national effluent guidelines for approximately 3000 facilities that are currently regulated under other existing point source categories (e.g., Metal Finishing - 40 CFR 433). The MP&M rule will also cover approximately 7300 facilities that are not currently regulated under any national effluent guidelines.
