Terms of Clearance: This approval is for a limited period. Based on discussions between OMB and DOL, it is understood that DOL will work on broadening and finalizing the 1999 proposed rule (establishing a safe harbor for the use of electronic technology for employee benefit plan disclosures) pertaining to 29 CFR 2520.104 to apply generally to disclosures under Title I of ERISA, including those covered by this approval action.

Abstract: ERISA section 404(c) provides that where a pension plan with individual accounts permits a participant or beneficiary (P or B) to exercise control over assets in his account and the P or B does o, the P or B will not be deemed to be a fudiciary by such actions, and no person otherwise a fiduciary shall be liable for any loss or breach which results from this exercise of control, if certain conditions are met.
