Manufacturers may install noncompli- ant engines in a portion or
all of their production for up to seven years after the effective
date of Tier 1 standards for compression ignition enginers rated
below 37 kW or Tier II standards for compression ignition engines
related at or above 37 kW, provided they comply with applicable
regulations found at 40 CFR 89.102 and keep records. Engine
manufacturers who supply the noncomplaint engines to be used under
this program must also submit reports and keep records of their
activities under the program.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies

1320.8(b)(3).
