Terms of Clearance: Approved consistent with ED's memos to OMB of 6/24/98 and 7/02/98. In addition, ED will submit to OMB within 6 months of this clearance a revised publisher survey which contains performance measure alternatives. Once this survey is implemented, ED will update OMB on the feasibility of replacing these regulatory requirements with performance measure alternatives. Further, ED will continue to monitor the effect of these regulatory provisions to both ensure that the rule is being implemented in the least burdensome way, and to gauge whether regulatory revisions are necessary to achieve the objectives of the rule in a less burdensome way.
