Terms of Clearance: Pursuant to 5 CFR 1320.1, this ICR is disapproved as inconsistent with the Paperwork Reduction Act of 1995 (PRA) as enacted at 44 U.S.C. 3501 et seq. Specifically, this ICR violates the requirement at 5 CFR 1320.4(b)(2) prohibiting collections that duplicate information otherwise available to the agency. Information regarding chemicals released, produced, utilized, or stored by entities in available from: - reports submitted to EPA under the TRI required by EPCRA sec. 313, - permits issued pursuant to Title V of the Clean Air Act, - permits issued pursuant to RCRA, - inspection reports of inspections conducted under those programs, - and information reported to States under sec. 311 and sec.312 of EPCRA that is available to EPA. OMB recognizes that an ICR may be necessary to gather meaningful data about some facilities for which other sources of information do not exist. Should EPA wish to resubmit this ICR, they should first examine the data available from the sources listed above and focus the collection on those entities about whom information on chemicals released, produced, utitlized, and stored is not otherwise available.

Abstract: The purpose of this ICR is to enable the Office of Chemical Emergency Preparedness and Prevention (OCEPP) in Region 5, to collect information from major stationary sources to determine the compliance status of these facilities, in order to fulfill its responsibilities as the implementing regional office of the Risk Management Program. OCEPP will use the data collected under this ICR as part of an enforcement/compliance project.
