Abstract: The Federal Food, Drug, and Cosmetic Act provides that States may petition the Food and Drug Administration for exemption of State requirements from the Federal preemption accorded therein. Section 100(d)(21 CFR 100.1(d)) sets forth the information a State is required to supply in such a petition.
