On-Highway engine manufacturers must
obtain a certificate of compliance with applicable emission
standards before the engine may be introduced into commerce.
Nonconformance penalties allow a manufacturer to introduce into
commerce heavy-duty engines (HDE) or heavy-duty vehicles (HDV),
including light-duty trucks (LDT), which fail to confirm with
certain emission standards upon payment of a monetary penalty. A
manufacturer that elects to pay a nonconformance penalty must
perform a Production Compliance Audit (PCA) to establish the
penalty amount. The collection activities include periodic reports
and other information.
