Water Discharges Associated with Construction Activity under an
NPDES General Permit (Proposed Rule for Construction and
Development)
The revisions to
this ICR related to the proposed construction and development
effluent limitations and guidelines are not approved, however
approval continues for the current reporting and record keeping
requirements related to the Phase I and Phase II stormwater
programs. It is not clear that the additional requirement to keep a
site log, including self certification of various regulatory
compliance activities,_has practical utility, as required by 5 CFR
1320.9(a), abd reduces to the extent practical and appropriate the
burden on persons who must provide information to the agency, as
required by_5 CFR 1320.9(c), including small entities. OMB notes
that three options have been co-proposed for the rule and that one
of the options would continue to rely on the existing site specific
regulatory requirements, including the existing record keeping and
reporting requirements, such as filing of a Notice of Intent and
Notice of Termination and preparation of a Stormwater Pollution
Prevention Plan, in lieu of additional requirements. If EPA
promulgates a final rule that includes additional reporting and
record keeping requirements over and above those in the existing
program, the agency should clarify in the preamble how these
requirements satisfy the provisions of 5 CFR 1320.9.

The proposed rule, "Effluent
Guidelines for Construction and Development" would add provisions
to construction activities currently regulated by the NPDES storm
water regulations. Con- struction site permittees would develop and
implement an inspection program, as recorded in a site log, and
certify that all provisions in the permit were implemented prior to
termi- nation of permit.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
