The information
collection provisions associated with the NPRM for reporting of
excess income are not approved at this time. HUD is examining
public comment in response to this NPRM. The preamble to the final
rule will address how the agency has addressed comments releated to
minimizing the burden of this collection while maximizing its
utility.

Project owners must submit a written
request to retain Excess Income, including the amount or percentage
of Excess Income requested; the period from which Excess Income is
being requested and, for project use, the proposed use of the
requested Excess Income. The request must be submitted at least 90
days before the beginning of each fiscal year, or 90 days before
any other time during a fiscal year that the owner plans to being
retaining excess income for that fiscal year. Corporate and other
entity applicants must verify their Employer Identification Numbers
(EIN).
