Abstract: Section 310 of the Federal Food, Drug, and Cosmetic Act authorizes States to enforce certain sections concerning the misbranding of food in their names. Section 100.2(d) (21 CFR 100.2(d)) sets forth the information a State must provide to FDA in a letter of notification that enforcement action will be taken.
