This ICR is
approved. However, the current submission does not include a form
for the waiver certification option for small construction sites.
Until this form is approved, operators may apply for the waiver by
submitting the following information: 1) name and address of small
construction site operator, 2) R factor calculation, including the
final calculated R factor for the site, and 3) a signed
certification statement that the site meets the eligibility
requirements for the waiver, as specified in 40 CFR 122.26(15).
Currently, this ICR estimates a burden of 1 hour for preparation of
the waiver application. When the final form is completed, EPA
should submit it to OMB for approval along with an ICR change
worksheet and reconsider whether the burden of 1 hour per form
remains appropriate.

This ICR calculates the burden and
cost associated with the regulation of storm water discharges under
Phase II of the NPDES storm water program. Specifically, it
calculates the burden of developing and implementing small MS4
storm water permits, small construction (1-5 acres) permits, and
submitting a no-exposure certification form (EPA form 3510-11). The
ICR also specifies the burden on authorized NPDES States to process
and administer the Phase II program.
