Approved. As an emergency clearance package, this collection is cleared for six months. In addition to the resubmission in or before May 2003, these terms of clearance serve as notice of OMB's intention of review of this information collection again in Spring 2004. At that time, OMB and Education will assess a number of issues related to information collection and implementation of No Child Left Behind. Because NCLB breaks a great deal of new ground, it is impossible to predict now the impact of a number of statutory and regulatory provisions. Because NCLB is such a high priority, it is essential that any unforeseen barriers to effective implementation be addressed as they are identified. By Spring 2004, there should enough data on accountability systems and the school improvement process to assess whether adjustments in either data collection or implementation should be made. At this time, Education will provide OMB with its assessment of and justification for any adjustments that should be made. If necessary, such adjustments may include amendments to regulations, legislation, or non-regulatory guidance. OMB will work with Education to help ensure that the appropriate State and Federal data collection systems are in place to inform such an assessment.

Section 200.83 of the regulations for Title I, Part C establishes the minimum requirements as SEA must meet for development of a comprehensive needs assessment and plan for service delivery as required under Section 1306(b) of the Elementary and Secondary Education Act (ESEA), as amended (P.L. 107-110). Section 200.84 of the regulations establishes the minimum requirements the SEA must meet to implement the program evaluation required under Section 1304(c)(2) of ESEA. Section 200.88 of the regulations clarifies that, for the purposes of the MEP, only "supplemenetal" State or local funds that are used for programs specifically ....
