P.L. 105-306 provided that nonqualified aliens who were receiving SSI on August 22, 1996, would remain eligible for SSI as long as all other requirements for eligibility were met. 20 CFR 416.1618 requires that nonqualified aliens give SSA certain evidence of their status in the U.S. in order to quality for SSI benefits. The respondents are PRUCOL aliens who must present evidence at the time of application of SSI benefits and periodically thereafter.
