that with the promulgation of a final rule on electronic passenger
manifests for all passengers, this collection will either (1)
require revisions or (2) be rendered unnecessary and/or obsolete.
The final rule on electronic passenger manifests is required by
Section 402 of the Enhanced Border Security and Visa Reform Act
2002. DHS will ensure that proper notice and comment is received
for this forthcoming information collection request.

Section 217(h) of the INA requires an
automated entry and exit control system by specifying those
passenger data elements that must be electronically transmitted to
the INS by carriers seeking to transport Visa Waiver Program
passengers into and out of the U.S. on or after October 1,
2002.
