As required by sections 4521, 4522, and 4523 of the Balanced Act of 1997, HCFA 1005 FC eliminates the formula drive overpayment for certain outpatient hospital services, extends reductions in payment for costs of hospital outpatient services, and establishes in regulations a prospective payment system for hospital outpatient services. The rule also establishes in regulations the requirements for designating certain entities as provider-based or as a department of a hospital.
