Statutes provide that the may require
commercial users of National Forest System roads to perform or pay
for maintenance made necessary by their use. Secretary of
Agriculture's regulations 36 CFR 212.5d authorizes the Chief of the
Forest Service to require commercial users to do so. The
requirement is made in FSM 7732.03. It is implemented through
orders under authority of 36 CFR 261.54(c). Form FS-7700-40 is the
standardized means for commercial haulers to apply for
permits.
