This ICR is
approved, with authorization to conduct up to 12 Focus Groups to
develop and pre-test a non-use valuation survey for impacts to fish
from cooling water intake structures. If EPA finds that it needs
more than 12 focus groups to adequately test and develop the
survey, EPA may request that the authorization be amended to
include additional focus groups as needed. As part of the review of
this ICR, OMB has reviewed an early draft of the survey instrument
and slide show that EPA wishes to test using the focus group
process. OMB has provided feedback to EPA on the draft survey,
which has been modified to partially address OMB's concerns.
However, OMB remains concerned that the current draft of the survey
instrument may not generate WTP values that can be appropriately
applied to the economic analysis for the 316(b) Phase III
rulemaking, which is the stated goal of the survey. OMB will
reconsider these issues when it reviews the ICR for the survey
itself, which we understand may be substantially modified from the
current draft, based on the results of the focus group
process.

The US Environmental Protection Agency

national performance standards for controlling impacts from cooling
water intake structures (CWIS) for Phase III facilities under
section 316(b) of the Clean Water Act (CWA).
