Terms of Clearance: This information collection is approved consistent with the 5/19/05 version approved by OMB. OMB does not approve any of the changes contained with the 6/17/05 version of this collection. Additionally, this collection is subject to the following four terms of clearance: 1. The Department of Education (Ed) will resubmit this collection to OMB when the final rule on the Individuals with Disabilities Education Act (IDEA) is submitted to OMB; 2. Ed will brief OMB on each of the information collections associated with the final IDEA rule; 3. Upon resubmission, Ed will consolidate the 21 information collections currently associated with this rule into several PRA packages; and 4. Upon resubmission, Ed will incorporate public comments and describe how this collection maximizes practical utility and minimizes public burden.

Abstract: According to 20 U.S.C. 1414(e)(C), each State receiving funds under Part B of the Individuals with Disabilities Education Act (Part B) must maintain a list of individuals who are qualified mediators and knowledgeable in laws and regulations relating to the provisions of special education and related services. Each public agency must also maintain a list of individuals who serve as hearing officers, along with the qualifications of each of these individuals. Maintaining these lists is a record keeping activity.
