The Department of Education (Ed) will resubmit this collection to OMB when the final rule on the Individuals with Disabilities Education Act (IDEA) is submitted to OMB; 2. Ed will brief OMB on each of the information collections associated with the final IDEA rule; 3. Upon resubmission, Ed will consolidate the 21 information collections currently associated with this rule into several PRA packages; and 4. Upon resubmission, Ed will incorporate public comments and describe how this collection maximizes practical utility and minimizes public burden.

Abstract: This collection is necessitated by 20 U.S.C. 1412(a)(10)(A)(v) of the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) and Section 300.136 of the proposed regulations that permits a private school official to submit a complaint to the State educational agency (SEA) that the local educational agency (LEA) did not engage in consultation that was meaningful and timely, or did not give due consideration of the private school official. Further, a private school official may submit a complaint to the Secretary, if the official is dissatisfied with the decision of the SEA.
