EPA should carefully review public comments on the proposed UCMR2 Rule and ensure that all record keeping and reporting requirements in the final rule satisfy the requirements in 5 CFR 1320.9 that the collection of information is necessary for the proper performance of the functions of the agency, is not unnecessarily duplicative of information otherwise reasonably available to the agency, and reduces to the extent practicable and appropriate the burden on persons who shall provide information to or for the agency, including small entities. In particular, the agency should ensure that the information collected does not duplicate information already collected under UCMR1.
