Abstract: Section 1531 of the Energy Policy Act required us to issue regulations addressing commingling of fuels. The regulations we have issued are at 40 CFR 80.78(a)(8)(ii)(B)and (iii)(A) and are designed to provide flexibility to retail stations and wholesale purchaser consumers related to commingling of ethanol blended and non-ethanol blended reformulated gasoline (RFG). Parties may be subject to optional recordkeeping and reporting as soon as June 1, 2006. We are requesting emergency approval of the information collection.
