Deferral of Duty on Large Yachts Imported for Sale

A. Justification


1. The collection of information is required to ensure compliance with 19 USC 1484b. This section provides that an otherwise dutiable large yacht (defined in the section as a vessel that exceeds 79 feet in length, is used primarily for recreation or pleasure, and has been previously sold by a manufacturer or dealer to a retail consumer) may be imported without the payment of duty if the yacht is imported with the intention to offer for sale at a boat show in the United States. The statute provides generally for the deferral of payment of duty until the yacht is sold but specifies that the duty-deferral period may not exceed 6 months.

2. The importer certifies to Bureau of Customs and Border Protection (CBP) that the yacht will be sold. That information is to be used by CBP officers to defer duties under 19 U.S.C. 1484b.

3. No improved information technology is known which would reduce the burden.


4. Since each notice is unique, this information is not duplicated elsewhere.


5. No additional consideration has been given to small businesses or entities.


6. Failure to collect this information would have the consequences of CBP denying entry of articles subject to exclusion orders issued by the U.S. International Trade Commission.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. Public comments were solicited through a Federal Register notices, dated, May 1, 2006 and July 14, 2006. As of this submission no comments have been received.


9. There is no offer of a monetary or material value for this information collection.


10. No change in assurances of confidentiality is provided with this information collection.


11. There are no questions of a personal or sensitive nature on this declaration.

12. Estimated Annualized Burden on the Public - The estimated burden for this information collection is 100 hours, based on an estimated 100 respondents filing an estimated 1 response each year. Each response requires an estimated 1 hour (60 minutes) to complete.


Estimated Annualized Cost to the Public. The estimated cost to the respondents is $2,000, based on 100 burden hours at an average rate of $20.00 per hour.


13. Estimated Record Keeping Burden on the Public. There are no record keeping cost associated with this information collection.


Estimated Capitalization Cost Burden on the Public. There is no capitalization cost associated with this information collection.


14. Estimated Cost to the Federal Government - The estimated annual cost to the Federal Government in handling, processing and recording the information collected with regard to this collection is $750, based on 15 minutes review per response at an average rate of $30.00 per hour. 100 x 15 minutes (.25) =25 hours. 25 hours x $30 per hour=$750
