seeks PRA approval for proposed revisions to EPA's CAFO
regulations, is not approved. EPA should carefully consider all
paperwork requirements during deveopment of the final rule and
ensure that they have practical utility and reduce to the extent
practicable and appropriate the burden on the public, as required
by 5 CFR 1320.9.

EPA is proposing to revise the
National Pollutant Discharge Elimination System (NPDES) permitting
requirements (Sec. 122) and Effluent Limitations Guidelines and
Standards (ELGs) Sec. 412) for concentrated animal feeding
operations (CAFOs) in response to the order issued by the Second
Circuit Court of Appeals in Waterkeeper Alliane et al. v. EPA, 399
F.3d 486 (2nd Cir. 2005). This proposed rule responds to the court
order while furthering the statutory goal of restoring and
maintaining the nation's water quality and effectively ensuring
that CAFOs properly manage manure generated by their
operations.
On behalf of this Federal agency, I certify that
