Justification for Change (1010-0114)
As of 7/17/06, the final rule for 30 CFR 250 became effective (71 FR 19640 4/17/2006). The rule collection (1010-0165, exp. 3/31/09) consists of burden hours relating to 30 CFR 250 subparts A and D (2,443 total hrs). MMS is, therefore, consolidating the burden hours (240) for 30 CFR 250, subpart D, into OMB No. 1010-0141 (exp 8/31/08). The remaining 2,203 hours are being consolidated into subpart A,1010-0114 (exp. 10/31/07). After OMB approves the consolidations, MMS will discontinue 1010-0165.
Also, this shows a program change to 1010-0114 due to rulemaking 1010-AD16, 70 FR 49871, August 25, 2005. Fees from the cost recovery rule were inappropriately calculated and added in a previous 83C submission (approved under Notice of Action 7/11/06). MMS had not accounted for the number of submissions times each fee in the previous 83-C.
